L'arte Milano rules for buying and selling goods
1.General provisions.
1.1 These Terms and Conditions of Purchase and Sale of Goods (hereinafter referred to as the "Terms and Conditions") are a binding legal document for the Buyer and UAB Baltijos Didmena, company code 125702927, VAT tax code LT257029219, (hereinafter referred to as the "Seller"), which sets out the rights and obligations of the Parties, the terms and conditions and procedures for concluding the Purchase and Sale Contract and for the delivery and return of the goods, and any other provisions relating to the purchase and sale of goods in the online store L'arte Milano.
These Terms and Conditions are drawn up in accordance with the Civil Code of the Republic of Lithuania, the Law on the Protection of Consumers' Rights of the Republic of Lithuania, the Directive on Electronic Commerce and sub-legislative acts.
1.2 The Buyer accepts these Terms and Conditions by registering on the L'arte Milano website.
1.3 The right to register and purchase goods on the L'arte Milano online shop is exclusively reserved to:
1.3.1. able-bodied natural persons, i.e. persons who have reached the age of majority and whose legal capacity has not been restricted by a court order;
1.3.2. minors between the ages of 14 and 18, with the consent of their parents or guardians only, except where they are disposing of their own income;
1.3.3. legal persons.
1.4 By accepting the Terms and Conditions, the Buyer confirms that he/she has the right to register and purchase goods in the L'arte Milano online shop in accordance with point 1.3 of these Terms and Conditions.
1.5 The "Frequently Asked Questions" section (hereinafter referred to as "FAQ") on the L'arte Milano website contains detailed information relating to the ordering of goods, delivery, return, etc. In light of the above, we recommend that you read the FAQs before using L'arte Milano.

2.Conclusion of the Purchase and Sale Agreement.
2.1 The contract between the Buyer and the Seller shall be deemed to have been concluded when the Buyer, having selected the product(s) to be purchased and having created a shopping cart (hereinafter referred to as the "Shopping Cart"), clicks on the "ORDER" link.
2.2 Upon conclusion of the Purchase and Sale Agreement, the range of goods, their quantity, price, delivery time and other terms and conditions specified by the Buyer at the time of placing the order shall be binding on the Buyer and the Seller and may be changed only in accordance with the procedure set out in these Rules.
2.3 Purchase and sale contracts shall be registered and stored in the L'arte Milano database.

3.Rights of the Buyer
3.1 The Buyer shall be entitled to purchase goods in the L'arte Milano online shop in accordance with these Conditions.
3.2 The Buyer shall have the right to withdraw from the Contract of Sale and Purchase of Goods concluded with the online shop L'arte Milano by notifying the Seller in writing (by e-mail, indicating the product to be returned and its order number) at the latest within thirty (30) days from the date of delivery of the quality goods. The Buyer shall have the rights provided for in the Lithuanian legislation upon purchase of a defective product.
3.3 The Buyer's right referred to in Clause 3.2 shall be exercised in accordance with Article 6.22810(1) of the Civil Code.
3.4 The Buyer may only exercise the Buyer's right referred to in clause 3.2 if the goods have not been damaged or substantially altered in appearance, nor have been used.
3.5 The Buyer shall have the rights provided for in the legislation of the Republic of Lithuania in case of purchase of defective goods.
3.6 Cancellation or adjustment of the ordered and formed shopping cart is possible before the order is submitted to the Seller. Once the order has been placed, there is no possibility of cancelling or adjusting it.
If the Shopping Cart is formed during a sale with a delivery period of up to 9 working days, cancellation or adjustment is not possible. Once an order has been placed for such Goods, the creation of the shopping cart shall commence immediately.
Notwithstanding the fact that the Buyer may not, in certain cases, cancel, void or adjust the basket of Goods ordered, the Buyer shall retain the right to withdraw from the Contract and to return the Goods in accordance with the procedure set out in these Conditions.

4.Seller's Rights.
4.1 If the Buyer attempts in any way to undermine the operation of the Online Shop, the security of the data, or materially breaches any of the Buyer's other obligations mentioned in Clauses 5.3 and 5.5 of the Terms and Conditions, then the Seller shall have the right to terminate the Buyer's registration or to otherwise restrict the Buyer's access to the Online Shop L'arte Milano.
4.2 Where the Buyer chooses to pay for the Goods by cash on collection or by prepayment and the Buyer cannot be contacted within the time limit specified for the delivery method chosen, the order shall be cancelled and returned to the Seller.

5.Obligations of the Buyer
5.1 The Buyer is obliged to pay for and accept the goods purchased in accordance with these Conditions.
5.2 If the Buyer refuses to accept the goods at the time of delivery without good reason, the Buyer shall be liable to pay the costs of returning the goods at the Seller's request.
5.3 The Buyer undertakes to protect and not to disclose to any third party his/her login data to the L'arte Milano online shop. If the Buyer loses his/her login details, he/she must immediately inform L'arte Milano's customer service department.
5.4 The Seller shall not be liable for the actions of third parties after the use of the Buyer's login data until the moment of informing the Seller and giving the webshop administrator the opportunity to change the Buyer's login data. In this case, L'arte Milano shall be entitled to assume that the Buyer has carried out the actions in the Online Shop.
5.5 The Buyers of the L'arte Milano Online Shop are obliged to comply with these Terms and Conditions, which are expressly indicated in the information sections of the Online Shop, and not to violate the legislation of the Republic of Lithuania.

6.Obligations of the Seller
6.1 The Seller undertakes to make available the services of the Online Shop, the conditions of operation of which are set out in these Conditions.
6.2 The Seller undertakes to deliver the goods purchased by the Buyer by the delivery method chosen by the Buyer, in accordance with the terms and conditions set out in these Rules.
6.3 The Seller undertakes to respect the Buyer's right to privacy with regard to personal information belonging to him.
6.4 Where, due to unforeseen circumstances, the Seller is unable to deliver the goods purchased in the L'arte Milano online shop, the Seller shall have the right to terminate the Purchase and Sale Agreement by informing the Buyer beforehand. The Seller may offer an equivalent product. If the Buyer refuses, the Seller undertakes to refund the money paid immediately.
6.5 If the Buyer exercises the right provided for in Clause 3.2 of the Terms and Conditions and in the event of the condition provided for in Clause 3.4 of the Terms and Conditions, the Seller undertakes to refund the Buyer's monies immediately and within a period of no more than 14 (fourteen) days from the day on which the Seller receives the Buyer's notice of withdrawal.
6.6 The Seller may not refund the amount paid by the Buyer until the Goods have been returned to the Seller or until the Buyer has provided proof that the Goods have been dispatched to the Seller, whichever is the earlier.

7.Prices of the Goods
7.1 The prices of the Goods in the Online Shop and in the order placed with L'arte Milano shall be quoted in the currency circulating in the country. The Seller is subject to VAT. VAT is included in the price and delivery charges are added to the total amount of the goods upon confirmation of the order.
7.2 The retail (reduced) prices quoted in the Sale are provided by the suppliers or official distributors of the goods sold. The reduced prices are the manufacturer's recommended retail prices at the sellers' direct outlets, showrooms and shops.

8.Payment procedures and terms of payment for goods
8.1 The Buyer shall pay for the goods purchased in one of the following ways:
8.1.1. by electronic banking
8.1.2. If you choose to pay by credit card, you will be able to make a direct transfer if the order amount does not exceed EUR 2172.15 (the amount may vary due to exchange rate fluctuations).
8.2 The Buyer undertakes to pay for the Goods promptly when paying by e-banking. Only after payment has been made will the shipment of goods be formed. If the order is not paid for within 1 hour, the order is removed from the system. If the sale ends before the deadline (1 hour), the orders are removed after the end of the sale.


9.Delivery
9.1 When purchasing goods in the L'arte Milano online shop, the Buyer shall choose the method of delivery of the goods: delivery service.
9.2 Delivery service:
9.2.1;
9.2.2. the Buyer undertakes to collect the goods himself. In the event that the Buyer is unable to take delivery of the Goods himself and the Goods have been delivered to the address indicated and on the basis of the other data provided by the Buyer, the Buyer shall not be entitled to make any claim against the Seller in respect of the delivery of the Goods to the wrong entity;
9.2.3. the Goods may be delivered by the Seller itself or by its authorised representative;
9.2.4.
9.2.5 The Buyer will see the exact amount of the delivery charge before confirming the order. The amount of the delivery charge will not be changed after confirmation of the order.
9.3 Delivery times are given in the description of the goods. The Seller undertakes to deliver the purchased goods as soon as possible.
9.4 The Seller shall be exempt from liability for breach of delivery deadlines if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer's fault or due to circumstances beyond the Buyer's control.
9.5 Upon receipt of the Goods, the Buyer shall inspect the condition of the consignment with the Seller or its authorised representative (whether the outer packaging is intact) and sign the invoice, bill of lading or other document of transfer and acceptance. Once the Buyer has signed the invoice, bill of lading or other document of transfer and acceptance, the consignment shall be deemed to have been transferred in good condition.
If the Buyer notices that the packaging of the delivered consignment is damaged (crumpled, wet or otherwise externally damaged), the Buyer must note this on the invoice, the waybill or other document of delivery and acceptance and draw up a free-form consignment damage report in the presence of the Seller or his representative. If the Buyer fails to do so, the Seller shall be exempt from liability in respect of damage to the Goods, provided that such damage does not arise from manufacturing defects, and in respect of inconsistencies in the assembly of the Goods, provided that such inconsistencies can be determined from an external inspection of the Goods.
If the Buyer, upon acceptance of the consignment, notices any discrepancy, manufacturing defect or other defects in the goods, the Buyer shall inform the Seller immediately (within 24 hours of receipt of the consignment at the latest). If the complaint is confirmed and the Buyer returns the goods of unsatisfactory quality, the Seller undertakes to refund the money for the goods within 14 (fourteen) days, together with the costs of return.
Buyers must in such case provide a return postage receipt.
9.6 The characteristics of all Goods sold shall be specified in the description attached to each Good. The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods in the online shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the monitor used by the Buyer.

10.Returns
10.1 Goods of good quality may be returned within 30 days of receipt. The defects of the goods sold in poor quality shall be eliminated, the goods in poor quality shall be replaced and returned in accordance with the provisions of the Civil Code of the Republic of Lithuania and the "Rules of Retail Trade" approved by the Government of the Republic of Lithuania.
10.2 In order to return the product(s) in accordance with clause 10.1, the Buyer shall fill in a return document.
10.3 The following conditions must be complied with when returning goods:
10.3.1. the returned goods must be in their original packaging in good working order (this clause does not apply in the case of returns of low quality goods);
10.3.2. the Goods must be undamaged by the Buyer;
10.3.3. the Goods must be unused and in good condition: labels intact, protective films intact, etc. (this point does not apply in the case of a return of low-quality Goods);
10.3.4. the quality of the returned goods (within 30 days) must be in the same condition as when received by the Buyer (this clause does not apply in the case of a return of low quality goods);
10.3.5. when returning the Goods, you must present the document of purchase, the warranty card (if issued) and the completed return document;
10.3.6 The Seller has the right to refuse to accept the Buyer's return if the conditions for the return of goods have not been complied with;
In the event that goods are returned in poor quality, the cost of returning the goods shall be borne by the Seller.

10.3.8. The return of the Goods shall be carried out in the manner prescribed by the Seller within 30 (thirty) days from the date of receipt of the Goods (this clause does not apply in the case of low-quality Goods, in which case return of the Goods shall be carried out within the statutory warranty period);
10.3.9. where the goods are returned pursuant to the right provided for in clause 4.2, the Buyer shall bear the costs of returning the goods.
In the case of a return of goods of poor quality, there is no cost to the customer for the return, which shall be borne by the Seller (the Customer must provide a return postage receipt).
10.4 Returns and exchanges of goods of satisfactory quality shall be made in accordance with Article 6.22810 of the Civil Code;
10.5 Money for returned goods may be refunded by bank transfer to the payer's bank account immediately and at the latest within 14 (fourteen) days of the Buyer's notice of withdrawal. The Seller may not refund the amount paid by the Buyer until the Goods have been returned to the Seller or until the Buyer has provided proof that the Goods have been dispatched to the Seller, whichever is the earlier.
The Seller shall not be liable for any failure or delay in making an order for returned goods if the Buyer incorrectly provides the details required for the return.

11.Exchange of information
11.1 The Seller shall inform the Buyer using the email address provided in the registration form, and the Buyer may use any of the contact channels indicated in the "CONTACT" section of the L'arte Milano online shop website.


12.Liability
12.1 The Buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer provides inaccurate data in the registration form, the Seller shall not be liable for the consequences arising therefrom and shall be entitled to claim direct damages from the Buyer.
12.2 The Buyer is fully responsible for his/her actions after registering on the L'arte Milano online shop.
12.3 The Buyer is responsible for the security of his/her registration data. If a third party uses the registration data, he/she shall be deemed to be the Buyer.
12.4 The Seller shall be exempt from any liability in all cases where the loss is caused by the Buyer's failure to read these Terms and Conditions (although he has been given the opportunity to do so), without taking into account the Seller's recommendations and h s obligations.
12.5 In the event of damage, the party at fault shall indemnify the other party for the loss suffered in accordance with the procedure and on the grounds set out in the laws of the Republic of Lithuania.


13.Final provisions
13.1 L'arte Milano reserves the right to suspend, amend and modify these Terms and Conditions and any other documents relating to these Terms and Conditions at its sole discretion. Amendments or changes to the Terms and Conditions shall take effect from the date of their publication (by means of e-mail, newsletters, posting on L'arte Milano's website) for all transactions entered into after the date of their publication, and the Customer is therefore advised to familiarise himself with the Terms and Conditions during each shopping trip.
13.2 If the Buyer does not agree with the new wording of the Terms and Conditions, amendments, modifications, the Buyer shall have the right to withdraw from them, provided that the Buyer shall lose the right to use the services of the Online Shop.
13.3 These Terms and Conditions are made in accordance with the legislation of the Republic of Lithuania.
13.4 The law of the Republic of Lithuania shall apply to relations arising from these Terms and Conditions.
13.5 All disagreements arising from the execution of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
13.6 The Parties shall be excused from the performance of their obligations under these Terms and Conditions if such performance is prevented by unforeseen circumstances beyond the control of the Parties, which include:
fire, explosion, storms and other natural disasters and acts of God, which prevent or delay the performance of the obligations undertaken;
an event or circumstance beyond the control of the Party(ies) to the Contract which prevents or delays the performance of the obligations assumed;
governmental or governmental action which prevents or delays the performance of the obligations assumed;
